Frankly, Computer, sometimes I'm not sure. Of course, everybody says "you're innocent until proven guilty" but in reality.....?

Recall recently there was this case of a teacher who went to a masseuse and then claimed he molested her. Based on newspaper report, it would seem as long as a woman cries molest, the onus seems to be on the accused to prove his innocence.

In this particular case, the man was convicted. It was simply the woman's words against his. And if the man can't convince the judge, then, that's it.

Anyway, I was really amazed that a teacher (reasonable level of education implied) would go to a male masseuse and agree to strip to her panties for the massage?

[the onus is on the prosecution to establish the case to convince the court that the accused is guilty. There are instances in SG court where the judges throw out the prosecutors' cases out due to inadequacy of evidence as viewed by the judges.

...just as the onus is on the defence to convince the court that the accused is innocent......there are also instances where innocent suspects/accused were treated like criminals until the judge threw out the prosecutors' cases and declared the suspects/accused innocent...

before judgement r passed down, the accussed are treated as suspect and not criminal

..so then in SG, what is the difference in the treatment of suspects and criminals..??.....

ask your lawyer friends whether SG is practising "guilty unless proven innocent" for criminal cases

actually, the lawyers themselves can argue until the cows come home and yet come to no conclusion...this is due to the minute differences in the law of every countries and that is what makes this subject so interesting...

things like A country might be following the law's of B country and while B country does not practise capital punishment, A country does...

also there are other differences in the penal code like a judge passing the judgement instead of a panel of jurors even tho' the laws of the 2 countries are similar...

in singapore, the basis of lawyers is to argue cases based on precedence but with our CJ Yong, this is not so evident nowadays...he is a very dynamic CJ who dares to set the precedence rather than follow precedence...

u can say SG is practising guilty unless proven innocent but i can also say otherwise because it depends on how u view the treatment of the suspects, as u say......
